Hearing- or speech-impaired \r\npersons may use the Telecommunications Devices for the Deaf (TDD) by \r\ncontacting the Federal Information Relay Service at 1-800-877-8339.\r\n\r\nSUPPLEMENTARY INFORMATION: The Department is amending Sec.  51.60 of \r\nsubpart E within part 51 of title 22 of the Code of Federal \r\nRegulations. The rules incorporate statutory passport denial and \r\nrevocation requirements as codified at 22 U.S.C. 2714a for certain \r\nindividuals who have seriously delinquent tax debt or submit passport \r\napplications without correct and valid Social Security numbers. The \r\nrules incorporate new provisions for denial and revocation of passport \r\nbooks that do not contain conspicuous identifiers for covered sex \r\noffenders as defined in 42 U.S.C. 16935a. The rule provides for denial \r\nof passport cards to these same covered sex offenders, as passport \r\ncards are not able to contain the unique identifier required by 22 \r\nU.S.C. 212b.\r\n    The new Sec.  51.60(a)(3) requires denial of a passport to an \r\nindividual who is certified by the Secretary of the Treasury as having \r\na seriously delinquent tax debt as described in 26 U.S.C. 7345.\r\n    The new Sec.  51.60(f) permits denial of a passport to an \r\nindividual who does not include his or her Social Security number or \r\nwillfully, intentionally, negligently, or recklessly includes an \r\nincorrect or invalid Social Security number on his or her passport \r\napplication.\r\n    The new Sec.  51.60(g) requires denial of a passport card to an \r\nindividual who is a covered sex offender as described in 42 U.S.C. \r\n16935a.\r\n\r\nRegulatory Findings\r\n\r\nAdministrative Procedure Act\r\n\r\n    Because this rulemaking implements the Congressional mandates \r\nwithin the FAST Act and IML, the Department is publishing this \r\nrulemaking without notice and comment under the ``good cause'' \r\nexemption of 5 U.S.C. 553(b). The Department believes that public \r\ncomment on this rulemaking would be unnecessary, impractical, and \r\ncontrary to the public interest. In addition, for the same reasons, the \r\neffective date for this rulemaking is the date of publication in \r\naccordance with the ``good cause'' provision of 5 U.S.C. 553(d)(3).\r\n\r\nRegulatory Flexibility Act\r\n\r\n    The Department of State, in accordance with the Regulatory \r\nFlexibility Act (5 U.S.C. 605(b)), has reviewed this regulation and, by \r\napproving it, certifies that this rule will not have a significant \r\neconomic impact on a substantial number of small entities.\r\n\r\nUnfunded Mandates Act of 1995\r\n\r\n    This rule will not result in the expenditure by state, local, and \r\ntribal governments, in the aggregate, or by the private sector, of $100 \r\nmillion or more in any year and it will not significantly or uniquely \r\naffect small governments. Therefore, no actions were deemed necessary \r\nunder the provisions of the Unfunded Mandates Reform Act of 1995.\r\n\r\nSmall Business Regulatory Enforcement Fairness Act of 1996\r\n\r\n    This rule is not a major rule as defined by section 804 of the \r\nSmall Business Regulatory Enforcement Act of 1996. This rule will not \r\nresult in an annual effect on the economy of $100 million or more; a \r\nmajor increase in costs or prices; or significant adverse effects on \r\ncompetition, employment, investment, productivity, innovation, or on \r\nthe ability of U.S.-based companies to compete with foreign based \r\ncompanies in domestic and import markets.\r\n\r\n[[Page 60609]]\r\n\r\nExecutive Orders 12866 and 13563\r\n\r\n    The Department of State does not consider this rule to be an \r\neconomically significant regulatory action under Executive Order 12866, \r\nRegulatory Planning and Review. The Department has nevertheless \r\nreviewed the regulation to ensure its consistency with the regulatory \r\nphilosophy and principles set forth in both Executive Order 12866 and \r\nExecutive Order 13563, and certifies that the benefits of this \r\nregulation outweigh any cost to the public.\r\n\r\nExecutive Order 13132\r\n\r\n    This regulation will not have substantial direct effects on the \r\nstates, on the relationship between the national government and the \r\nstates, or on the distribution of power and responsibilities among the \r\nvarious levels of government. Therefore, in accordance with section 6 \r\nof Executive Order 13132, it is determined that this rule does not have \r\nsufficient federalism implications to require consultations or warrant \r\nthe preparation of a federalism summary impact statement.\r\n\r\nExecutive Order 13175\r\n\r\n    The Department has determined that this rulemaking will not have \r\ntribal implications, will not impose substantial direct compliance \r\ncosts on tribal governments, and will not pre-empt tribal law. \r\nAccordingly, the requirements of Executive Order 13175 do not apply to \r\nthis rulemaking.\r\n\r\nPaperwork Reduction Act\r\n\r\n    This rule does not impose any new reporting or record-keeping \r\nrequirements subject to the Paperwork Reduction Act, 44 U.S.C. Chapter \r\n35. Prior to the passage of the FAST Act, passport applicants were \r\nalready asked to provide their Social Security numbers to obtain or \r\nrenew passports. With respect to the IML requirements, the applicant \r\ndoes not report his or her status as a covered sex offender to the \r\nDepartment during the application process; rather, the Department \r\nobtains that information from other government sources. Therefore, this \r\nrulemaking imposes no additional burden on the applicant.\r\n\r\nList of Subjects in 22 CFR Part 51\r\n\r\n    Passports.\r\n\r\n    Accordingly, for the reasons set forth in the preamble, the \r\nDepartment has amended 22 CFR part 51 as follows:\r\n\r\nPART 51--PASSPORTS\r\n\r\n0\r\n1.
