{"id":2473,"date":"2017-07-26T20:42:56","date_gmt":"2017-07-27T00:42:56","guid":{"rendered":"http:\/\/sexoffenderonestopresource.com\/florida\/?p=2473"},"modified":"2017-07-26T20:42:56","modified_gmt":"2017-07-27T00:42:56","slug":"legal-update-sorr-challenge","status":"publish","type":"post","link":"https:\/\/sexoffenderonestopresource.com\/florida\/legal-update-sorr-challenge\/","title":{"rendered":"Legal Update: SORR Challenge"},"content":{"rendered":"<div class=\"et_post_meta_wrapper\">\n<h1 class=\"entry-title\">Legal Update: SORR Challenge<\/h1>\n<\/div>\n<div class=\"entry-content\">\n<p>Many have been asking about the status of the SORR (Sex Offender Residency Restriction) Challenge which was recently reversed (in our favor) in the 11th Circuit (Federal Appellate Court).<\/p>\n<p>Trial in this case is scheduled for the two-week period commencing\u00a0\u00a0<strong>Monday, March 19, 2018.<\/strong><\/p>\n<p>Although that seems a while away and you may be thinking \u201cwhy so long?\u201d, if you consider the scheduling order set by Judge Huck, you will hopefully appreciate all that needs to happen in this case until then.<\/p>\n<p>170 days \u2013 Motions to join additional parties, amend pleadings, and for class certification must be filed.<\/p>\n<p>140 days \u2013 Plaintiffs shall furnish opposing counsel with a written list containing the names and addresses of all\u00a0\u00a0<u>expert<\/u>\u00a0 witnesses intended to be called at trial. Only\u00a0 those\u00a0\u00a0<u>expert<\/u>\u00a0 witnesses identified by name shall be permitted to testify.<\/p>\n<p>130 days \u2013 Plaintiffs shall furnish opposing counsel with a written report from each expert intended to be called at trial. Within the fourteen (14) day period following service of each expert\u2019s written\u00a0 report, Plaintiff shall make its experts available\u00a0 for\u00a0 deposition\u00a0 by opposing counsel. The experts\u2019 depositions may be conducted without further order from the Court.<\/p>\n<p>130 days \u2013 Parties shall furnish opposing counsel with a written list containing the names and addresses of all witnesses intended to be called at trial. Only those witnesses identified by specific name or title (not by category or adoption by reference) shall be permitted to testify.<\/p>\n<p>120 days \u2013 Defendant shall furnish opposing counsel with a written list containing the names and addresses of all\u00a0<u>expert<\/u>\u00a0 witnesses\u00a0 intended to be called at trial. Only those\u00a0\u00a0<u>expert<\/u>\u00a0 witnesses\u00a0 identified by name shall be permitted to testify.<\/p>\n<p>110 days \u2013 Defendant shall furnish opposing counsel with a written\u00a0 report from each expert intended to be called at trial.\u00a0 Within the fourteen(14) day period following service of each expert\u2019s written report, Defendant shall make its experts available for deposition by opposing counsel. The experts\u2019 depositions may be conducted without further order from the Court.<\/p>\n<p>100 days \u2013 If Plaintiffs did not initially disclose experts\u00a0 but Defendant elects\u00a0 to utilize experts and discloses them, then Plaintiffs shall furnish opposing counsel with a written list containing the names and addresses of any\u00a0<u>rebuttal<\/u>\u00a0expert witnesses intended to be called at trial. Only those\u00a0<u>rebuttal<\/u>\u00a0expert witnesses identified by name shall be permitted to testify.<\/p>\n<p>90 days \u2013 Plaintiffs shall furnish opposing counsel with a written report from each rebuttal expert intended to be called at trial. Within the fourteen (14) day period following service of each expert\u2019s report, Plaintiff shall make the expert available for deposition by Defendant.
