{"id":689,"date":"2017-09-01T17:12:41","date_gmt":"2017-09-01T21:12:41","guid":{"rendered":"http:\/\/sexoffenderonestopresource.com\/indiana\/?p=689"},"modified":"2017-09-01T17:31:35","modified_gmt":"2017-09-01T21:31:35","slug":"indiana-court-rules-school-ban-for-parents-unconstitutional","status":"publish","type":"post","link":"https:\/\/sexoffenderonestopresource.com\/indiana\/indiana-court-rules-school-ban-for-parents-unconstitutional\/","title":{"rendered":"Indiana Court Rules School Ban for Parents Unconstitutional"},"content":{"rendered":"<div class=\"et_post_meta_wrapper\"><\/div>\n<div class=\"entry-content\">\n<p><a href=\"https:\/\/floridaactioncommittee.org\/wp-content\/uploads\/2017\/09\/Kirby-v.-Indiana.pdf\"><\/a><\/p>\n<div class=\"et_post_meta_wrapper\">\n<h1 class=\"entry-title\">Indiana Court Rules School Ban for Parents Unconstitutional<\/h1>\n<\/div>\n<div class=\"entry-content\">\n<p>In another big win yesterday, an Indiana appellate Court determined that a law banning sex offenders from schools is Unconstitutional as applied to parents of children attending that school whose cases pre-date the law.<\/p>\n<p>The Judge\u2019s order found that restricting the registrant from his own child\u2019s school was a \u201cdisability or restraint [that] is neither minor nor indirect\u201d. It was punishment. He found \u201cschools\u2014especially school sporting events\u2014have been open to members of the public. It seems reasonable to assume, therefore, that the act of restricting an individual from entering school property has historically been considered a form of punishment.\u201d<\/p>\n<p>The plaintiff in the case challenged the Indiana law on three grounds; first that it constituted Ex Post Facto Punishment, second for vagueness and third, that the statute violated his due process interest in the care, custody, and control of his son.
